These Terms of Service (“Terms”) govern your access to and use of Zelko’s website, mobile application, and AI-powered real estate media services (collectively, the “Service”) provided by Zelko, Inc. (“we,” “us,” or “our”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and legally able to form a binding contract to use the Service. By using the Service you represent and warrant that you meet these requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@estatevision.ai if you suspect unauthorized access.
You may not share accounts or create accounts on behalf of another person without their authorization.
You may use the Service to generate AI-enhanced real estate images and marketing copy for lawful real estate marketing purposes. You agree not to:
The Service uses third-party AI models (including fal.ai and Anthropic Claude) to transform images and generate text. You acknowledge that:
Certain features consume credits. Credits are non-refundable except where required by law. We reserve the right to adjust credit costs with 14 days’ notice.
Subscription plans auto-renew monthly. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
We use Stripe to process payments. By purchasing credits or a subscription you agree to Stripe’s Terms of Service.
You retain ownership of the original images you upload. By uploading images you grant us a limited license to process them solely to provide the Service.
We grant you a non-exclusive, non-transferable license to use AI-generated outputs for your real estate marketing. You may not claim copyright ownership of AI-generated images in jurisdictions where such claims are not permitted.
Zelko, its logos, and all Service software are owned by Zelko, Inc. and protected by intellectual property laws.
The Service integrates with third-party platforms (Zapier, Follow Up Boss, HubSpot, and others). Your use of those platforms is governed by their respective terms of service. We are not responsible for third-party platform failures, data loss, or policy changes.
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL MEET YOUR EXPECTATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZELKO, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Zelko, Inc., its officers, directors, and employees from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms.
We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or non-payment. You may delete your account at any time from the Dashboard settings.
Upon termination, your right to use the Service ceases immediately. We may retain data as required by law or our Privacy Policy.
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.
